TRUCK PARKING SERVICE AGREEMENT
Truck Parking Service Agreement for 344 Sackville Drive – Lower Sackville, Nova Scotia
Between 48 Taxi (Service Provider) and Client (Tenant).
1. Purpose of Agreement
This Agreement outlines the terms under which 48 Taxi (“Service Provider”) provides truck and trailer parking spaces at 344 Sackville Drive, Lower Sackville, Nova Scotia, and the conditions under which the Client (“Tenant”) may use the premises.
2. Parking Location & Access
- Parking spaces are located at 344 Sackville Drive, Lower Sackville, NS.
- Access is available 24 hours per day, 7 days per week, unless restricted for safety or maintenance.
- Tenant may only use designated parking spaces provided by the Service Provider.
- The Tenant must not obstruct entrances, exits, or other vehicles.
3. Vehicle Registration & Identification
- The Tenant must provide license plate numbers, make, and model for all vehicles and trailers that will access or park on the premises.
- Due to the nature of the Tenant’s operations, both owned and non-owned trucks/trailers are permitted onsite.
- The Tenant must notify the Service Provider of any new or replacement vehicles accessing the property.
- Unregistered or unidentified vehicles may be removed at the Tenant’s expense.
4. Term & Renewal
- This Agreement is month-to-month, beginning on the date of signing.
- Renewal is automatic with monthly payment.
5. Fees, Deposit, and Payment Terms
- Monthly parking fee: $350 CAD per parking spot, plus applicable taxes.
- Payment due on or before the 1st of each month, in advance.
- A refundable deposit equal to one month’s parking fee is required at signing.
- Refund occurs within 15 business days after termination, subject to outstanding balances or damages.
- Late payments (7+ days overdue) incur a $25 late fee.
- The Service Provider may adjust monthly rates with 30 days’ written notice.
6. Remote-Control Access Device
- Each Tenant may obtain a gate/lot access remote.
- Remote fee: $20 per remote (non-refundable).
- Remote deposit: $70 per remote refunded upon return, if applicable.
- The Tenant is fully responsible for the remote.
- If the remote is lost, stolen, or damaged, replacement cost is $100, payable immediately or deducted from the deposit.
7. Authorized Uses
7.1 Parking
- Park trucks, trailers, and related commercial vehicles.
7.2 Light Maintenance & Washing
- Perform light maintenance activities on vehicles.
- Allow mobile truck washing services on the premises.
- Heavy repairs, engine work, welding, or environmental waste disposal are not permitted.
7.3 Smoking Policy
- Smoking is strictly not permitted anywhere on the property.
8. Prohibited Uses
The Tenant agrees NOT to:
- Store hazardous or flammable materials.
- Perform fuel transfers or major mechanical work.
- Block traffic flow or access routes.
- Abandon vehicles.
- Create excessive noise or nuisance.
9. Service Provider Responsibilities
- Maintain general lot conditions (lighting, snow clearing, basic upkeep).
- Provide reasonable access, subject to weather and maintenance conditions.
- Permit tenant vehicles and additional trailers onsite subject to safety and operational rules.
The Service Provider does not provide security or guarantee protection from theft, damage or fire.
10. Tenant Responsibilities
- Ensure all vehicles are insured and safe to operate.
- Keep the area clean and avoid fluid leaks.
- Ensure all employees, subcontractors, or drivers comply with this Agreement.
- Immediately report hazards or incidents.
- Follow all posted and written rules.
11. Liability & Insurance
- All vehicles enter and park at the Tenant’s own risk.
- The Service Provider is not liable for theft, vandalism, damage, fire, or personal loss.
- The Tenant agrees to indemnify the Service Provider against claims arising from use of the premises.
- The Tenant must maintain appropriate commercial vehicle insurance.
12. Default & Enforcement
The Tenant is in default if they:
- Fail to pay fees on time.
- Violate any conditions of this Agreement.
- Bring unregistered vehicles onsite.
- Cause damage to the property.
The Service Provider may respond by:
- Restricting access,
- Terminating the Agreement,
- Towing vehicles at Tenant’s expense.
13. Termination
- Either party may terminate with 30 days’ written notice.
- Upon termination, the Tenant must remove all vehicles within 48 hours.
- Deposits are refunded after confirming:
- All payments are complete
- Remote returned (if any)
- No outstanding damages or violations
14. Governing Law
This Agreement is governed by the laws of the Province of Nova Scotia.
15. Entire Agreement
This document represents the entire understanding between the Parties and replaces all prior versions.
Amendments must be in writing and signed by both Parties.
