“ PARKING SERVICE AGREEMENT ”
Property Address: 344 Sackville Drive, Lower Sackville, Nova Scotia
Between: 48 Taxi (“Service Provider”) and (“Client”)
1. Purpose of Agreement
This Agreement establishes the terms and conditions under which the Service Provider grants the Client the right to use designated areas for truck and trailer parking at the above-mentioned property.
2. Parking Location and Access
- Parking spaces are located at 344 Sackville Drive, Lower Sackville, NS.
- Parking is permitted only within designated areas assigned by the Service Provider.
- Access to the premises is available 24 hours per day, 7 days per week, unless temporarily restricted for safety, weather conditions, emergency condition or operational requirements.
- The Client shall not obstruct entrances, exits, fire lanes, or other vehicles at any time.
3. Vehicle Registration and Identification
- The Client must provide full details (license plate, make, and model) of all vehicles and trailers accessing the premises.
- Both owned and non-owned commercial vehicles may be permitted, subject to approval.
- The Client must promptly notify the Service Provider of any additions or changes.
- Unauthorized or unidentified vehicles may be removed at the Client’s sole expense.
4. Term and Renewal
- This Agreement shall commence on the starting date and continue a month-to-month basis.
- The Agreement shall automatically renew each month unless terminated in accordance with this Agreement.
5. Fees, Deposit, and Payment Terms
- Monthly fee for Truck: $350 CAD per parking space, plus applicable taxes.
- Monthly fee for Buses, RV, Towing & Dump truck: $350 CAD per parking space, plus applicable taxes.
- Monthly fee for All size Containers: $350 CAD per parking space, plus applicable taxes.
- Monthly fee for one vehicle: $150 CAD per parking space, plus applicable taxes.
- Payment is due in advance on or before the 1st day of each month.
- A refundable deposit equal to one (1) month’s fee is required upon signing.
- Deposit refunds will be issued within 15 business days following termination, subject to deductions for damages, unpaid fees, or violations.
- Payments more than 7 days overdue will incur a $50 per week late fee.
6. Access Devices (Remote Control)
- Remote access devices may be issued at the Service Provider’s discretion.
- Fee: $45 per remote (non-refundable).
- Deposit: $70 per remote (refundable upon return).
- Lost, stolen, or damaged remotes will result in a $100 replacement charge.
7. Permitted Use of Premises
7.1 Parking
The Client may use the premises solely for parking commercial trucks, trailers & related vehicles.
7.2 Strict Limitation on Maintenance Activities
- Only minor, non-invasive maintenance is permitted. This includes basic activities such as visual inspections, tire checks, or minor adjustments that do not involve tools, dismantling, or mechanical work.
- Vehicle washing by mobile services is permitted, provided no environmental harm or drainage issues occur.
- The following are strictly always prohibited:
- Mechanical repairs of any kind
- Engine work or diagnostics
- Welding, fabrication, or part replacement
- Oil changes or fluid handling/disposal
- Any activity involving tools, equipment, or materials that may create spills, contamination, or safety risks
- Any costs, damages, cleanup, fines, environmental charges, or repairs arising from any maintenance, washing, leakage, spill, contamination, or prohibited activity shall be the sole responsibility of the “Client”. The Service Provider shall bear no liability for such expenses, and the truck owner shall reimburse the Service Provider immediately upon demand.
- The “Client” shall be solely responsible, at their own cost and expense, for immediate removal & lawful disposal of any leftover materials, parts, debris, or waste generated by or brought onto the premises, including but not limited to tires, tire remnants, scrap metal, pallets, packaging, containers, fluids, batteries, broken parts & any other discarded items. Any cleanup, hauling, storage, disposal, environmental fees, or related charges incurred by Service Provider due to the failure of the truck owner and/or operator to remove such items shall be reimbursed by the truck owner immediately upon demand.
The Service Provider maintains a strict no-repair policy. The premises are intended for parking use only, not as a repair or service facility.
7.3 Smoking Policy
Smoking is strictly prohibited anywhere on the property.
8. Prohibited Uses
The Client shall not:
- Store hazardous, flammable, or illegal materials
- Conduct fuel transfers or refueling operations
- Block traffic flow or emergency access routes
- Abandon vehicles
- Create excessive noise, nuisance, or unsafe conditions
- Dogs are not allowed within the Parking lot.
9. Service Provider Responsibilities
The Service Provider shall:
- Maintain general property conditions, snow removal, and basic upkeep
- Provide reasonable access, subject to external conditions
- Enforce site rules for safety and order
Disclaimer: The Service Provider does not provide security and is not responsible for theft, vandalism, fire, or damage.
10. Client Responsibilities
The Tenant shall:
- Maintain valid insurance for all trucks, Containers and vehicles
- Ensure trucks, Containers and vehicles are in safe operating condition
- Keep the premises clean and free of leaks, debris, or waste
- Ensure all drivers, employees, and contractors comply with this Agreement
- Report any hazards or incidents immediately
11. Liability and Insurance
- All trucks, Containers and vehicles are parked at the Client’s sole risk.
- The Service Provider shall not be liable for any loss, damage, or injury.
- The Clients agrees to indemnify and hold harmless the Service Provider from any claims arising from use of the premises.
- The Client’s must maintain appropriate commercial liability insurance.
Assumption of Risk and Indemnity for Injury:
- The Client and/or operator acknowledges that the premises are intended solely for parking purposes and that entry to and use of the premises are at their own risk. The Client or operator shall be solely responsible for any injury, death, loss, or damage suffered by themselves, their employees, agents, passengers, contractors, or invitees arising from:
- the use of the premises;
- the parking, movement, loading, unloading, maintenance, or operation of any vehicle;
- any prohibited activity under this Agreement; or
- any act, omission, negligence, or misconduct of the truck owner and/or operator or their employees, agents, contractors, or invitees.
- The Client and/or operator shall indemnify, defend, and hold harmless the Service Provider, its owners, employees, and agents from and against all claims, demands, damages, losses, liabilities, costs, fines, penalties, and legal fees arising from any such injury, death, loss, or damage.
- This clause shall not apply to the extent that the injury or damage is directly caused by the gross negligence or wilful misconduct of the Service Provider.
12. Default and Enforcement
The Client will be considered in default if they:
- Fail to make payments on time
- Breach any term of this Agreement
- Bring unauthorized trucks, Containers and vehicles onsite
- Cause damage or safety risks
The Service Provider reserves the right to:
- Suspend or restrict access
- Terminate the Agreement immediately
- Remove or tow vehicles at the Client’s expense
13. Termination
- Either party may terminate this Agreement with 30 days’ written notice.
- Upon termination, all trucks, Containers and vehicles must be removed within 48 hours.
- Deposits will be refunded subject to:
- Full payment of all outstanding amounts
- Return of all access devices
- No damages or violations
14. Governing Law
This Agreement shall be governed by the laws of the Province of Nova Scotia.
15. Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior discussions or agreements.
Any amendments must be made in writing and signed by both parties.
